W przypadku stwierdzenia niezgodności, Konsument ponosi odpowiedzialność za zmniejszenie wartości Towaru będące wynikiem korzystania z niego w sposób wykraczający poza sposób konieczny do stwierdzenia charakteru, cech i funkcjonowania Towaru. Sprzedawca zastrzega sobie prawo do pomniejszenia kwoty zwrotu proporcjonalnie do zmniejszenia wartości Towaru.
